I agree with everything that has just been said, especially the no spanking. Positive reinforcement is always better. And a bellyband is a good idea.

Is your dog fixed? If not that would definetly be something you should consider. It would cut down on the hormones, keep from accidental puppies and it is supposed to prevent certain conditions as well. Plus this could be a territorial thing. He is marking and remarking his territory. I would find a really good non ammonia based cleaner and clean the areas really well. Positive reinforcement and the crate training would work better than the other way you are doing. I know it is frustrating but in reality if they mess in the house it is our fault not theres. It means we werent paying attention to what they are doing. Kinda like a child. If you cant be with him all the time I would put him in the crate. Immediately take him outside to do his business praise and treat immediately. Make this treat something special. Do not give this treat out except when he does his business outside. It has to be something he loves!!!!It will be a hard thing at first. Plus there is something that is called a bellyband that you can buy to put on him. It goes around his belly and his privates. So when he get the urge to go he end up getting himself. That would also be a good deterent. I am sure you can find them online.

I hope that some of these suggestions help you. And it will take time to amend these behaviors. Be patient and know that he wants to please you.

Definitely don't spank Oscar. Ever. Potty training can be frustrating, and even I yell at my dog from time to time, but please don't hit your dog. It is wrong even if you think it's not hurting him.

I think you should try positive reinforcement. Try to be patient. You should keep him in his crate and when you come home or in the mornings, take him outside immediately and when he goes potty, give him a treat and praise him. At first he might go potty in his crate, but that's better than somewhere in your house. After a while, Oscar will learn that outside is the place he should go potty. You should try to take him on walks because he will most likely go potty during walks. If you have any more questions or need more advice, just ask.
